✦ Terms of Service ✦

By commissioning me you're agreeing to ALL of my terms of service.
If you have questions about any of these terms, you can ask me via VGen/Twitter(X)/Discord/Email.

✦ Will Draw ✦

Your original characters / Fanart / Minimal lewd content / Minimal Blood / Monster characters / Simple backgrounds / Male or Female presenting characters

✦ Will NOT Draw ✦

Mecha / Furry / Animals(pets) / Excessive gore / Illegal activities / Detailed backgrounds / Anything I'm uncomfortable with

✦ INFORMATION ✦

· I am allowed to stream/post any WIPs (work in progress) and finished commissions anywhere I see fit (Example: Streaming on Twitch/YouTube/Etc, posting on Twitter/X/Bluesky/Etc), except for private/NDA commissions. All commissions will be posted to my portfolio eventually.· I ask that I am treated with respect and patience, due to life and my health complications I may not be able to work on your commission every day. If I feel like I am being rushed, disrespected, or mistreated in any form then I have the right to cancel the commission.· I have the right to decline any request that might make me uncomfortable, replicate another's style, that I feel I'm unable to do or complete in time.· I will not be held responsible for any misunderstanding or failure to read my Terms of Service.· You must ALWAYS credit me for any work I've done for you in easily accessible places such as one of these: Website credits/Twitter bio/Twitch Panels/Etc
· You may ask for me to keep a final piece private for up to 1 month after final delivery, but I will always stream/post WIPs(work in progress) You are NOT allowed to ask me to keep a commission completely private unless you have paid for the NDA/Privacy fee.· If you plan to sell/giveaway the commissioned piece, I ask that you inform me beforehand so that I am aware of what is happening and who will be getting the piece. You are NOT allowed to sell it for more than you paid me (any tips/boosts/donations are not included in that price)· You are NOT allowed to use any source to convert VTuber.moc3 files into VTuber.cmo3 files, if you would like the .cmo3 file you may ask me.· You are NOT allowed to use the commissioned piece in any AI-related technology such as: AI Art Generators, Gemini AI, ChatGPT, etc or any blockchain-related technology, including NFTs and cryptocurrency.

✦ PAYMENT ✦

· Payment is 100% upfront unless a payment plan has been agreed on.· Payment plans available on commissions above $30· If you need your art sooner, please ask about rush fees. Rush fee price changes depending on how soon the deadline is.· If I find that your design may be more complicated then I will add a complexity fee. Complexity fee can range from +5% to +30%, It's best to judge your design based on my chart.· For prices check my services or Here

Payment Plan Options

Payment plans can be adjusted to fit your budget.· 2 part payment plan: 50% now, 50% before final delivery.
· 3 part payment plan: 30% now, 30% midway, 40% before final delivery.
· 4 part payment plan: 25% now, 25% later, 25% midway, 25% before final delivery.

✦ REVISIONS ✦

· 3 major & 5 small revisions are free while in sketch phase, color changes are always free. Anything beyond those will be a charge of $5 per major & $2 per small. I will inform you if one of the revisions is being used.· Any large design changes after the sketch has been approved will cost $20, small changes will be $10.

✦ CANCELLATION AND REFUNDS ✦

· Cancellations are accepted before any payment is made.· No refunds or cancellations allowed after payment is made, so make sure you're 100% positive before commissioning me.· If I am cancelling your commission, you will receive a partial refund depending on how much of the commission is finished.· If I contact you with an update and I do not receive a response within 7-10 days I will continue the commission and send it as finished. NO REFUND AVAILABLE IN THIS SCENARIO.

✦ DEADLINES AND DELIVERY ✦

· Usual delivery/TAT is 2 weeks to 4 months depending on detail and commission type. I will let you know if more time is needed.· During the process, I will keep you updated about the progress of your piece with included images (watermarked) while it is a WIP (work in progress).· When the commission is finished, you will receive a ZIP file of your commissioned piece to either to the email you provided or the websites delivery system.· If you commission a VTuber/Animation ready to rig piece from me and the Rigger that you choose needs something changed, feel free to contact me.

✦ PRIVACY FEE & 90 DAY POLICY ✦

· NDA/Privacy fee will add an extra 20% to the total commission price.· Paying for the NDA/privacy fee means that I will not show/stream/post any WIPs(work in progress) or finished commission piece until the date you set.

The 90 day policy:

After receiving your model/art and you see something you'd like to have tweaked or fixed up, you have a 90 day "warranty" to come to me and ask me to fix it for you.· For Art: This is only for color changes, and adding details I missed.
· For Rigging: This is for something that might be clipping through other parts, fixing physics, etc.

✦ COMMERCIAL USE ✦

Commercial use comes with Content/Monetized use for no extra cost. To do this select both options on VGen and I'll manually deduct the 25% for monetized use.

Personal Use
What I DON'T consider Monetized or Commercial/Merch:

· pictures or banners for platforms you don't get payment from (Example: discord, steam, etc)· Sharing on social media without promoting anything besides yourself as an influencer. (with credit to me as the artist)· Emotes for Discord· Unpaid entry Giveaway/Raffle (if you commission me to make art for a free-entry raffle)

Content/Monetized use: +25%
What I DO consider Monetized:

· Profile picture or banners for any platform you get payment from (Example: Twitch affiliate or partner, YouTube partner, etc)· Overlays/BG for streaming· Emotes for Twitch· Sponsorship posts/ads / Event promos / Merch promos· Paid entry Giveaway/Raffle (if you commission me to make art for a raffle that requires payment to enter)· VTuber Models (comes with full commercial in base price)

Commercial/Merch use: +100%
What I DO consider Commercial/Merch:

· Merch (shirts, mousepad, stickers, body pillow cases, album covers, etc)· Art for music videos· Patreon/membership rewards· VTuber Models (comes with full commercial in base price)
